Victoria’s road traffic accident claim settles for £50,000 (Larne)

Victoria was involved in a Road Traffic Accident near Larne. She was driving in the direction of Belfast when a car emerged from a side road and collided with the rear nearside of her vehicle. The car sustained extensive damage including a broken rear axle. The vehicle was deemed a write off as a result of the collision.

Accident Injuries

Victoria was immediately shaken. She suffered an injury to her neck, both shoulders, lower back and debilitating pain around the hip area. On the recommendation of a friend, she approached Patrick O’Hare of Paschal O’Hare Solicitors to pursue a claim for compensation on her behalf.

Medical Reports Obtained

Liability for the accident was quickly admitted by the third party driver’s insurance company. We made arrangements for Victoria to be examined by a consultant orthopaedic surgeon. At the time of the initial examination, she was complaining of right sided groin pain which had not improved and her walking distance was very limited. In light of the extent of her symptoms, further investigations were required. We obtained a report from a consultant radiologist which concluded that there was evidence of degenerative change within the right hip with cyst formation within the roof of the acetabulum. Upon review of this x-ray report it was felt that the accident had rendered previously asymptomatic degenerative change symptomatic. It was felt that the accident had brought forward symptoms in Victoria’s hips by a period of time.

Degenerative Hip Symptoms Advanced

Further investigations were carried out and Victoria was examined by an expert on behalf of the defendant. The joint position of both doctors was that the accident in question had brought about an advancement of symptoms by up to 1-2 years. The symptoms which Victoria experienced were very debilitating and had a significant impact on her daily life. She was forced to give up work because of the increasing pain she was experiencing. It was felt that she would require a hip replacement but that she was too young to undergo a hip replacement at this juncture.

Car Accident Claim Settles

The defendant invited negotiations in the case. It was made clear during the negotiations that Victoria was suffering a significant de-compensation in her quality of life. The case ultimately settled in the sum of £50,000 plus costs.
