Ava's hearing loss claim settles for £11,250 (Newtownabbey)
Ava was employed by Nortel for nearly 30 years. She held numerous roles in the company including as a rack wirer where she used a noisy pneumatic gun and subsequently as a supervisor where she had to sit close to loud industrial machinery. She suffered for years with hearing loss and ringing in her ears.
Ava suffered hearing loss for many years
Ava contacted Paschal O’Hare Solicitors and we arranged an initial audiogram hearing test for her which showed evidence of noise-induced hearing loss. We then arranged an appointment with a Consultant ENT Surgeon who confirmed that he believed she had noise-induced hearing loss and clinically moderate tinnitus which often disturbed her sleep. He apportioned 50% of her symptoms to her time in Nortel and the rest to natural causes.
We then sent a letter of claim to the insurers for Nortel for the period she was employed there and subsequently issued proceedings. The solicitors for the Defendant arranged for their own defence medical report to be done and their doctor agreed with the conclusions in our medical expert’s report.
Negotiations took place and originally the Defendants were not willing to agree to any amount exceeding £10,050. Eventually, we managed to negotiate a figure of £11,250 for settlement.
