Kate's Car Crash Claim Settles for £10,000 (Crumlin)
Kate was stationary in her car waiting for the opportunity to pull out on to a roundabout when another car crashed into her rear. The force of the crash was so bad that it knocked her car out on to the roundabout. Thankfully, other drivers managed to avoid colliding with her also. Her vehicle sustained significant damage and she also suffered from various injuries.

Kate’s injuries were consistent with whiplash. She experienced pain and stiffness in her neck, back and shoulder. As a previous client of Paschal O’Hare Solicitors, she contacted us promptly and without hesitation. We sent a letter of claim to the driver’s insurance and liability was admitted. Subsequently, we sent Kate for an examination by an orthopaedic surgeon.
Prior to the examination, Kate was experiencing significant shoulder problems and had been attending a physiotherapist. When examined the medical professional diagnosed her with capsulitis, also known as frozen shoulder. This required two injections of anaesthetic. Despite the accident making this worse, the doctor believed it predated the accident. As part of the claim, we sent a medical report to the insurance provider.
The insurer is firm on a low settlement offer
As a result of the report, the insurer adopted a hard line view on the value of the case and offered a settlement figure of £4,500. Feeling like Kate deserved more, we rejected this amount. As a consequence, we issued legal proceedings against the insurer who quickly indicated willingness to look at the medical evidence again. Further negotiations took place and the case was settled in the sum of £10,000.
