Doreen's Slip Claim Settles for £25,000 (Belfast)
Doreen was having a meal in a restaurant at Belfast’s Victoria Square Shopping Complex. As she was walking within the restaurant both feet slipped from underneath her causing her to fall. She instinctively tried to save herself and landed hard on her side. At the moment she hit the ground, Doreen felt severe pain. She was unable to get to her feet and required assistance from two security guards and her husband. During this time, Doreen's husband ran his hand over the ground where his wife had fallen and noted that the smooth tiling was soaked with a greasy material.
A full hip replacement
As a result of this accident, Doreen suffered a fractured hip and went on to undergo a full hip replacement. On the recommendation of a friend, Doreen approached Paschal O’Hare Solicitors to pursue a claim for compensation on her behalf.
We sent a letter of claim to the owners of the restaurant on behalf of our new client. However, liability was denied by the insurance company in robust terms. High Court Proceedings were issued after medical evidence was obtained detailing the full extent of the plaintiff’s injuries.
The restaurant was well below the minimum health & safety threshold
During the course of the legal proceedings, we arranged an inspection of the restaurant's tiling by a consulting engineer retained on behalf of Doreen. The consultant’s readings were well below the minimum health & safety standard in its category. Subsequently, the report highlighted that there was a high risk of a slip when grease or water was present.
After the engineer’s inspection took place the defendant approached us with a view to negotiate a settlement. Negotiations took place and the case settled on a compromise basis in the sum of £25,000 plus costs.
