Stuart’s Accident at Work Settles for £15,000 (Carrickfergus)

Stuart was working as a stock assistant in a supermarket in Carrickfergus. He was pulling a two-sided cage from the main freezer through a doorway when a box of frozen chips fell from the top of the pile, landing on and injuring his left hand.

He reported the incident to his night shift and line manager, and they informed him that they would put it in the accident book. Stuart was a determined worker and tried to work on, but increasing pain caused him to attend hospital, where it was determined that he potentially suffered a fractured wrist. He returned to work, but he had to be moved to the crisp aisle instead where he did lighter duties.

Stuart waited almost two years for a steroid injection to his wrist, but unfortunately this did not provide him with relief. Instead, he subsequently had to be operated on and had to take time off work, where he lost pay.

Almost 3 years after the accident, Stuart instructed Paschal O’Hare Solicitors to pursue a claim. Our solicitors had to work quickly, issuing protective proceedings straight away and sent a letter of claim to the supermarket.

The supermarket denied liability, stating that they never had any record of this incident ever occurring. We provided them with medical records which referenced the incident, but they still didn’t accept liability.

Meanwhile, we had the client medically examined, and it was determined by the examining doctor that it was not clear he had actually sustained a fracture as a result of the injury, but a subsequent MRI in fact revealed that he had suffered a tear in the triangular fibrocartilaginous complex with evidence of degenerative change in his wrist joint. The doctor felt this had actually pre-dated the accident and the client would likely have required surgery without the incident occurring, but it could have meant that he required it earlier than he would have.

We served proceedings and after exchanging documents and negotiation, we were able to agree settlement in the sum of £15,000.
