Máire’s car crash claim settles for £10,500 (Claudy)

Máire was driving through Claudy when she came to a stop at a give way sign. Unfortunately, a tractor failed to spot her and collided with the rear of her vehicle. It was a heavy impact crash and the police were required to attend. The farmer admitted liability at the scene. As a result of the crash, Máire suffered from soft tissue injuries to her neck, back and wrist. Given the force of the collision, she was lucky to have avoided more serious injuries.

Máire decided to claim for her injuries

Máire contacted us with a view to claim for compensation. In order to begin the claiming process, we searched for the tractor’s registration number in the insurance database but no results were offered. The client passed on the farmer’s policy number that she obtained from the PSNI and the name of his insurer who we then wrote to. Unfortunately, the insurer didn’t acknowledge our multiple attempts at correspondence. We eventually managed to corner the insurer who explained that the policy number didn’t exist.

In the meantime, we sent Máire to a consultant orthopaedic surgeon who provided a medical report detailing the injuries sustained. We used this report to work out the amount of compensation we believe the client was entitled to.

Shortly after, the Máire was able to obtain the correct policy number associated with the tractor. The wrong policy number had previously been given in error. From here, the claims process continued as normal. As the farmer had already admitted liability we entered settlement negotiations with the insurer who offered £9,000 in compensation. This offer was rejected and a slightly higher sum of £10,500 was negotiated.
