Beat the clock when submitting a claim

There are a number of misconceptions about how long you have to seek compensation following an accident. Some people believe that the process must begin immediately or risk losing out. Others think they can submit a claim at any time regardless of the number of years that have passed. In reality, there is a reasonable time limit in place – 3 years.

Once the 3 year period from an accident has expired the window of opportunity may be closed for good. After this it’s no longer possible to submit a claim. However, there are some exceptions.

The time limit is for the submission of a claim rather than its conclusion. This is because some cases can run on for several years depending on complexity. Furthermore, the 3 year limit begins from the point of a diagnosis of an injury rather than the exact date that the injury occurred. This is because some injury types don’t manifest themselves for years. Common examples of this happening is with noise-induced hearing loss and asbestosis, both of which may not develop symptoms for a while.
