Edward’s car accident settles for £45,520 (Belfast) 

Edward was involved in a road traffic accident on York Street in Belfast. His vehicle was struck by a third-party driver who pulled out from a side road. His vehicle was badly damaged and was declared a write off.

Edward suffered a lower back injury and developed tinnitus after hitting his head off the window in the impact of the collision. He contacted his GP who referred him to physiotherapy for his back and to the Royal Victoria Hospital for tinnitus management.

Edward contacted Impact-NI to arrange a hire vehicle and subsequently made contact with us in relation to his physical injuries. He grew increasingly concerned about his injuries. He decided to contact our solicitors to learn about his options. We advised that we could help. 

After initially consulting with Edward, we sent a letter of claim to the insurer claiming compensation for his injuries and seeking recovery for his vehicle pre-accident value and credit hire. The insurer agreed to deal with the claim and quickly raised payment for his vehicle’s pre-accident value in the sum of £12,900. This enabled Edward to end his hire and seek a replacement vehicle.

We arranged to have Edward examined by a Consultant Orthopaedic Surgeon and a Consultant ENT Surgeon for his injuries. The Consultant Orthopaedic Surgeon concluded that Edward had suffered a straining injury to the lower back which should resolve within 12 months of the date of the accident. The Consultant ENT Surgeon concluded that Edward’s tinnitus would likely persist on a permanent basis. We served the medical evidence on the insurer and negotiations commenced. An initial offer of £11,000.00 was made for Edward’s injuries. We advised Edward that his case was worth more, and we subsequently issued Court proceedings in the High Court.

After a period of negotiations between the third-party solicitor, our Counsel, Impact-NI and our client, a figure of £22,500 was proposed for Edward’s injuries which he was delighted to accept. A sum of £10,020 was agreed for Impact-NI for credit hire. Therefore, in settlement of Edwards’s claim for injuries, vehicle pre-accident value and credit hire, a total sum of £45,520 was agreed.
