Ethan’s pedestrian accident settles for £40,000 (Carrickfergus)

Ethan was involved in a pedestrian road traffic accident in Carrickfergus. The accident occurred at a set of traffic lights. He started crossing the road when the lights turned green in his favour. As he was approaching the other side when a car pulled out of an adjacent petrol station at an angle at speed. The vehicle went through the red light. Ethan took evasive action to avoid being struck by the car, jumping backwards and falling onto his right elbow.

As a result of this accident, Ethan suffered a fracture to his elbow and associated ligament damage. He initially attended Antrim Area Hospital where he underwent x-rays. He subsequently attended the Royal Victoria Hospital and underwent surgery.

Liability was quickly admitted by the driver’s insurance company. A report was obtained from a consultant orthopaedic surgeon. This report detailed the extent of the injury and the problems which the Plaintiff sustained. 

Negotiations were undertaken. An initial offer of £14,000 was made which was rejected out of hand. A significantly increased offer of £37,000 was made. Again, this was rejected. A final figure of £40,000 was made and the case settled.
