Ian’s Slurry Pit Accident Claim Ballinamanard, County Fermanagh

Ian was working as a line patroller inspecting pylons near a farm in Ballinamanard, County Fermanagh, when a serious accident occurred. Heavy snow had been falling that day. While taking shelter in a covered area of the farm, he suddenly fell into an unmarked and unsecured slurry pit. Ian managed to pull himself out, but the experience left him deeply shaken and traumatised.

Paschal O’Hare Solicitors Took On His Claim

The farm was owned by a company that had rented the land to a local farmer. Both denied responsibility. The company argued that the farmer was in charge of securing the pit, while the farmer claimed Ian had no right to be in that area and should have realised it was a slurry pit.

Partner Seymour Major took on Ian’s case. He obtained several expert reports, including one from a Consultant Psychiatrist who diagnosed Ian with Post Traumatic Stress Disorder (PTSD). Court proceedings were issued, and the defendant’s own psychiatric expert later agreed with our diagnosis.

Settlement Secured

The case was listed for trial, but after detailed negotiations, Seymour secured a settlement of £125,000 for Ian. This compensation reflected the trauma he endured and the lasting psychological impact of the accident.

Partner Seymour Major Commented

“Ian faced a frightening and entirely avoidable experience. We were determined to ensure that he received proper recognition for the serious psychological harm caused and the ongoing impact this incident has had on his well-being.”
