Jack’s work accident settles for £30,000 (Carrickfergus)

Jack was involved in a work accident when he was employed at a supermarket in Carrickfergus. The accident happened when he was moving some goods from the top of a stacked cage. As he was doing so, two boxes fell from the cage and landed on his foot. 

He was in a great deal of pain and he attended the Mater Hospital where it was confirmed he had sustained a fractured big toe. He had to wear a supportive boot for 6 weeks and took time off work to recover from his injuries. The injury also affected his hobbies such as playing rugby.

He confirmed that Jack sustained a comminuted intra-articular fracture to the base of the distal phalanx of the left great toe. This carried an increased risk of post-traumatic osteoarthritis of the joint in the toe and the possibility of requiring an arthrodesis of the joint if he developed chronic pain. 

Our solicitors sent a letter of claim to his employer who denied liability. They stated that he was the author of his own misfortune for pulling the boxes from the top of the stacked cage. We issued proceedings and the other side obtained a defence medical report who confirmed that the ongoing stiffness the client was experiencing in the toe would be permanent. 

We set the case down for hearing and shortly before trial, the case was settled for £30,000. Jack was happy with the result.
