Jason was driving a work vehicle outside Armagh, heading towards Moy, when a vehicle coming from the opposite direction veered onto his side of the road. This resulted in a high-impact, head-on collision that caused Jason’s van to flip over. Emergency services, including the police and ambulance, attended the scene, and Jason was taken to Craigavon Hospital by ambulance. He was x-rayed and examined before being discharged.
Jason Contacted Our Work Vehicle Accident Solicitors
Jason suffered multiple injuries in the accident, including soft tissue injuries to his neck, back, and chest wall, a torn ACL in his right knee, and a soft tissue injury to his ankle. He also experienced psychological injury and developed tinnitus. Initially, the third-party insurer was unable to proceed with their investigations as the defendant was in critical condition. However, they eventually agreed to handle the case on a “without prejudice” basis.
Due to his injuries, Jason was unable to work for some time and was only receiving Statutory Sick Pay (SSP). Our team at Paschal O’Hare Solicitors quickly secured an interim payment of £6,000 to assist him with his living expenses while he was off work.
We obtained medical evidence from a Consultant Orthopaedic Surgeon, who confirmed that Jason’s symptoms should settle within 18 months but that he would be left with scarring on his ankle. A Consultant Psychiatrist diagnosed him with Post Traumatic Stress Disorder (PTSD), which should resolve within 12 months. Additionally, a Consultant ENT Surgeon diagnosed him with moderate, permanent tinnitus.
Successful Negotiation for a Fair Settlement
After gathering all the necessary medical evidence, we entered negotiations with the third-party insurers. Initially, the insurers were reluctant, but we successfully secured a settlement of £120,000 for Jason.
Partner Seymour Major commented:
“We are pleased to have secured a fair settlement for Jason. His life was significantly impacted by this accident, and this compensation will aid in his recovery and future well-being. Our priority is always to support our clients through challenging times and ensure they receive the justice they deserve.”
