Michelle was walking across a road in East Belfast when he was involved in a pedestrian accident. She was struck on her knee and landed on the ground, she was taken to the Royal Victoria Hospital by ambulance and was kept in overnight.

We immediately conducted a search of the third party’s vehicle registration in order to establish the identity of their motor insurer. A letter of claim was directed to them setting out our client’s allegations. An admission of liability was not forthcoming. We immediately applied for a copy of the Police Report and obtained statements of witnesses who were at the scene. We were able to secure an admission of liability a short time later.
Chris arranged for Michelle to be examined by a Consultant Orthopaedic Surgeon and a Consultant Psychiatrist. We gathered Michelle’s hospital notes along with GP notes and records and provided these to the Consultants. Michelle was suffering back, neck, shoulder and knee pain as a result of the accident. The medical report documented the reduction of the client’s recreational activities as a result of his injury, the Consultant was of the view that this would continue for up to 15 months. Michelle was also diagnosed as suffering from an adjustment disorder.
We entered into negotiations with the third party insurer. An initial offer of £5,000 was made, which was rejected. We were of the view that to obtain adequate compensation for our client, court proceedings would be required.
Court proceedings were issued and we were able to negotiate a settlement of £19,500 prior to her hearing.
