Multi-Car Accident Victim Secures £90,000 Judgement in High Court

Rachel was coming home from work in County Down and stopped to allow an emergency vehicle pass. She then felt two large impacts as two cars behind her went into her and each other. 

She was in shock at the time and subsequently was diagnosed as having suffered a concussion after being taken to hospital. She began experiencing pain in numerous areas of her body and also started to suffer from a ringing in her ears.

Rachel was concerned about her injuries and reached out to our solicitors for help. After speaking to her about her situation we advised that we could help her and we sent a letter of claim to the driver behind her. 

Initially, the insurers agreed to deal with the claim and we obtained reports from a Consultant Orthopaedic Surgeon who said that her soft tissue injuries should clear up within 18 months, from a Consultant ENT Surgeon who advised that she will be left with permanent moderate tinnitus, from a Consultant Neurosurgeon who confirmed she had suffered a concussion, the symptoms of which resolved within a few months and from a Consultant Psychiatrist who advised that she had suffered an exacerbation of an anxiety/depressive disorder which should resolve within 18 months and also ongoing travel anxiety. 

She also had loss of earnings and recoupment due to her employer in the sum of £3,800. After discussions with the insurers, they would only agree to pay £20,000 which we would not recommend to Rachel. We issued proceedings against them and it then became apparent that there was an ongoing dispute between the two drivers behind her as to who was at fault. We joined another driver for the proceedings. The Defendants organised a defence medical report with an ENT Consultant who agreed entirely with the findings of our expert. 

The case was listed for hearing and on the day of the hearing, the Defendants proposed a settlement figure of £50,000. We advised Rachel to reject this and after hearing the case in court, the Judge awarded the sum of £90,427, inclusive of interest.
