Nicola was involved in a car accident when she was driving in Bangor. She was travelling along a road near her home when another vehicle suddenly reversed from their driveway and struck the passenger side of her vehicle. Nicola suffered whiplash injuries, ringing in her ears and psychological upset due to the accident.

She contacted our firm shortly after the accident to find out whether she could claim for her injuries. Nicola was able to provide us with the details of the Third Party vehicle, and we were able to carry out a search to identify their insurer. A letter of claim was sent to the insurer, who responded with an allegation that she rear-ended their insured’s vehicle. She was able to provide us with photographs of her vehicle damage which showed damage to the passenger door. This rebutted their allegation and the insurer agreed to meet her claim in return.

We arranged for her to get the medical attention she deserved

We first arranged for Nicola to be examined by a Consultant Orthopaedic Surgeon. The Consultant reviewed her relevant GP records and examined her. He suggested that Nicola was suffering from a whiplash associated disorder with continuing pain in her neck, shoulder and lower back. He gave her musculo-skeletal symptoms a prognosis period of approximately 6-9 months from the date of the examination. He also commented that she was suffering from psychological symptoms and tinnitus, and advised that we should obtain reports from the relevant experts.

We arranged for Nicola to see a Consultant Psychiatrist, who commented that she suffered an exacerbation of anxiety and depression related to the accident. He recommended treatment and concluded that symptoms should resolve within 6 months of the commencement of the same. Nicola also saw a Consultant ENT Surgeon, who diagnosed her with mild-moderate tinnitus which he concluded was permanent.

Nicola received the compensation that she deserved

We served our client’s medical evidence on the insurer and entered into a period of negotiation. A figure of £22,000 was initially proposed by the insurer, however upon discussing this Nicola, we felt this was not entirely reflective of her injuri es. We sought a higher offer and finally, a figure of £25,000 was agreed between the parties in settlement of the claim.
