Michael’s pedestrian accident settles for £15,000 (Belfast)

Michael had been travelling on a bus from Belfast City Centre. When he got off he stepped out from behind the bus before it had continued down the road. Unfortunately, a passing motorist struck him. The driver stopped and immediately blamed Michael for the accident and they exchanged information. Although injured, Michael was able to hobble back home. He had significant pain and swelling in his ankle which lead him to visit hospital. He was soon diagnosed with a fractured ankle and various soft tissue injuries.

Michael contacted Paschal O’Hare Solicitors

Michael contacted us and we took on his case. We sent a letter of claim to the driver’s insurer who began to investigate the matter. Although they indicated a willingness to settle, they alleged that Michael was partly at fault. This is known as contributory negligence and you can learn more about it here. We sent Michael to be examined by a consultant orthopaedic surgeon who provided us with medical evidence that suggested it would take Michael 18 months to recover.

We sent this evidence to the insurer who offered a settlement of £12,750. After a small amount of negotiation we settled the case for £15,000.
