Deborah was traveling as a passenger in a friend’s car near the Westlink in Belfast when a road traffic accident occured. Another vehicle was driving in the lane to the left of Deborah and her friend and it suddenly attempted to turn on to a street to the right. The car making the illegal maneuver collided with the vehicle that Deborah was travelling in.
At the scene of the accident the other driver went on the offensive and attempted to blame Deborah’s driver for the accident.
It was clear that the third party driver was attempting to make a turn when it was not permitted to do so
The driver should have made this maneuver at a previous junction to where the accident occurred. It appeared to Deborah and her friend that the occupants of the other car were making their way to the SSE Arena in Belfast and has missed their turn.
Deborah suffered injuries as a result of this accident. Following a brief online search Deborah came across Paschal O’Hare Solicitors and decided to instruct us to pursue a claim on her behalf.
We sent a notification of a claim for compensation to the defendant’s insurers. After investigating the matter, liability was admitted. Medical reports were obtained from a consultant orthopaedic surgeon. We also obtained a report from an ears, nose and throat (ENT) Surgeon because Deborah was suffering from buzzing in her ears following the accident. The medical report indicated that the tinnitus was due to the accident.
Passenger Accident Claim Settles
The medical reports were served on the insurance company. An initial offer of £6,000 was made. This was rejected out of hand. The insurance company came back with an improved offer of £8,000. Again this was rejected. Further negotiations took place and the case settled in the sum of £10,000.
