David’s Pedestrian Accident Settles for £80,000 (Belfast) 

David was involved in a pedestrian accident when on his way to pick up some food in Belfast. He was crossing the road when a car driven by the third party drove into him. The driver of the vehicle immediately apologised and said he didn’t see him. 

David couldn’t get up and an ambulance and the police were called. He was taken to the RVH where it was determined he had sustained a fracture to his left ankle/foot. He required two operations and had to have metal pins inserted.

He obtained a report from a Consultant Orthopaedic Surgeon who confirmed that David would be left with permanent scarring in the area and would suffer long term pain and stiffness as well as be at the risk of development of arthritic change. Seymour also obtained a report from a Consultant Psychiatrist who confirmed that he suffered an adjustment disorder which may take around 2 years to ease without cognitive behavioural therapy.

We served medical evidence on the insurers and they initially made an offer of £10,000 to settle the case. Despite me outlining to them the seriousness of the injury, they were only willing to increase the offer to £17,500. Seymour issued proceedings against them and the solicitors acting for the insurers made a lodgement of £65,000 in the case. Eventually, a figure of £80,000 was negotiated, which David was happy to accept.
