Roslyn was involved in a road traffic accident whilst on a driving lesson along the Shore Road in Newtownabbey. Roslyn contacted Paschal O’Hare Solicitors and discussed the circumstances of the accident with our solicitor Olivia Moffitt during her free consultation. A file was quickly set up and a search was carried out against the vehicle registration number of the third-party vehicle which identified an insurer. A letter of claim was sent to the insurer and the insurer agreed to settle the claim.
Roslyn was complaining of soft tissue injuries as well as psychological upset. We arranged for her to see a Consultant Orthopaedic Surgeon and a Consultant Psychiatrist. Our Consultant Orthopaedic Surgeon determined that Roslyn had sustained whiplash injuries to her neck and back, and concluded that the residual symptoms should resolve within a period of 12-15 months from the date of the accident. The Consultant Psychiatrist diagnosed travel anxiety and an adjustment disorder which he concluded should resolve within 4-6 months of his examination of Roslyn.
We served the medical reports on the insurer and invited them to make an offer of settlement. The insurer initially responded with an offer of £4,500. Our solicitor Olivia Moffitt quickly pointed out that this figure was too low, referring the insurer to a recent judgment which valued similar claims much higher. The insurer agreed to increase their offer to £10,000, however, this was still not considered to be a recommendable figure. Through further negotiations, a figure of £18,500 was finally offered and Roslyn was delighted to accept this.
