Simon’s work accident settles for £45,000 (Lisburn) 

Simon was involved in a work accident when he was tasked with unloading a large container in Lisburn. A short-reach manitou was provided to unload the truck however this wasn’t suitable for the job and as a result, Simon had to jump in and out of the large container from a height around 15 times. There were no ladders or proper way of exiting and entering the truck safely. 

Simon began to experience significant pain and he subsequently attended the Royal. Initially he was sent home however after re-attending, he was diagnosed with a fracture of his L5 vertebrae.

We sent a letter of claim to his employer and, initially, liability was admitted. We obtained a medical report from a Consultant Orthopaedic Surgeon who noted a significant history of back issues but related symptoms for a period of months to the accident. An offer of £25,000 was made but rejected. Since there was no further increase being given, proceedings were issued. 

The solicitors for the Defendant then retracted the insurers’ admission of liability and confirmed they were now denying liability stating that the work would not have caused the injury Simon alleged. They obtained a defence medical report and we obtained further commentary from our medical expert on the foot of this. We also obtained Engineering evidence regarding the system of work that was in place at the time. The case was scheduled for hearing and subsequently settled before hearing for the sum of £45,000.
