Eileen’s slip claim settles for £15,000 (Newtownabbey)

Eileen was out for a meal at a restaurant in Newtownabbey with her partner. She left her table for a moment and upon her return she slipped and fell onto her hand which she outstretched in an attempt to catch herself. Whilst still lying on the ground, she noticed that her leg was wet from landing on the substance that she slipped on.

Eileen felt embarressed and wanted to leave immediately

When she got home she applied an ice-pack to her hand. She believed this would alleviate the pain for good, however the following morning her arm was swollen. A visit to Belfast’s Royal Victoria Hospital indicated that Eileen’s wrist was broken.

The broken wrist required the insertion of a metal plate.

Eileen contacted Paschal O’Hare Solicitors to pursue a claim for compensation. Liability was firmly denied by the restaurant on the basis that the accident was not witnessed and that they had a reasonable system of inspection to deal with spillages and hazards.

We obtained a medical report and immediately issued High Court proceedings against the restaurant. The defendant’s solicitor approached us wishing to negotiate before the trial. During these discussions, a settlement of £15,000 was agreed upon.
