Peter was involved in a serious workplace injury when he was employed as a tree surgeon. He was standing on a fully extended ladder using a chainsaw to cut tree branches when one of the branches crumbed causing him to lose his balance. He fell forwards and landed heavily on his left ankle. The injury was so severe that the ambulance brought him to a hospital where he underwent surgery involving wound wash out, internal fixation of the medial and lateral malleolous with repair of the attachment of the anterior talofibular ligament and reconstruction of the ankle joint surface. He was left with permanent surgical scarring.

Initially Peter’s employer denied liability on the basis that he was not wearing a safety harness at the time of his accident. However, it was alleged by Peter that his employer condoned a practice whereby members of staff routinely did not wear harnesses when working at height. As a result of the denial of liability High Court proceedings were issued. When Peter returned to work he took photographs that showed his colleagues routinely working at height without harnesses. A report was obtained from a Consulting Engineer which was supportive of Peter’s case. Prior to the hearing at the High Court, negotiations took place and the case settled for £50,000 plus High Court costs.
