Phillip was employed as a maintenance person by a healthcare group. He was applying a coat of wood stain on trellises which were located on an uneven surface. Phillip was on the third step of a small ladder when the steps wobbled quite significantly. He fell and hit his left elbow off one of the boulders at the edge of a pathway.
Phillip was taken to hospital due to the seriousness of his injury. He was initially advised that nothing was broken. Ultimately, he was diagnosed with a fracture dislocation of his left elbow.
Phillip decided to pursue a claim

A letter of claim was sent to the Defendant and liability was admitted by the defendant’s insurers. Medical reports were obtained from a consultant orthopaedic surgeon and a consultant radiologist. The diagnosis was one of dislocation of the elbow joint with spontaneous relocation. An MRI Scan revealed additional injuries including evidence of a full thickness tear of the medial epicondyle. Expert medical advice suggested that Phillip would have ongoing permanent symptoms.
We pressed on with the claim and the employer invited us to settlement negotiations. Several offers were made by the defendant insurers but were rejected out of hand. We settled the claim for the sum of £32,000 in compensation.
