Christine was shopping in a frozen food store when she suffered a serious accident. After picking up a few items, she realised she’d missed something and retraced her steps. As she turned back up an aisle, she tripped over boxes lying near the end of a freezer, which she hadn’t been able to see. Attempting to break her fall, Christine extended her left arm, resulting in severe pain. The shop staff promptly helped her onto a seat, apologised, and mentioned they were about to clear the boxes. Christine was then taken to Ulster Hospital in Dundonald, where a CT scan confirmed a dislocated left shoulder and the need for a partial shoulder replacement.
Christine Reached Out to Paschal O’Hare Solicitors
Following her initial treatment, Christine decided to seek compensation. On the recommendation of a friend, she contacted Paschal O’Hare Solicitors, where Managing Partner Patrick O’Hare took on her case. Early in the process, Paschal O’Hare commissioned medical reports from an orthopaedic surgeon, dermatologist, consultant psychiatrist, and care expert. They revealed that, beyond her shoulder injury, Christine’s pre-existing psoriasis had worsened due to the accident. Although liability was initially admitted, the defendant offered a pre-medical settlement of £3,000, which Paschal O’Hare rejected, deeming it inappropriate given the severity of Christine’s injuries.
High Court Proceedings and Rejected Offer
Due to the serious nature of her injuries, High Court proceedings were initiated. Despite initial admission, the defendant denied liability in court and argued contributory negligence. However, CCTV footage clearly supported Christine’s case, indicating that she wasn’t at fault. During negotiations, an offer of £75,000 was made, but it was rejected, as further medical evaluations confirmed the extent of her injuries, including a fractured shoulder, joint dislocation, and severe nerve damage affecting her arm, causing ongoing pain.
Settlement Achieved After Updated Medical Reports
Following the service of our updated reports, further negotiations took place. Her case ultimately settled for £150,000 plus High Court costs.
Managing Partner Patrick O’Hare Commented
“We are absolutely delighted with the level of settlement achieved in this case. The initial offer from the defendant was completely unacceptable and we did not share their view on the issue of liability. The settlement award is a significant figure and will help our client going forward into the future”
