Cycling Accident Victim Secures £75,000 Judgement in High Court

The plaintiff was cycling on Cardonaghy Road, Co Antrim when he was involved in a serious accident. He was going down the road when he was unexpectedly struck by a ladder carried by one of the employees working near the road. The impact sent the plaintiff tumbling to the ground, leading to serious injuries.

Legal Consultation and Representation

The plaintiff was concerned about his injuries and reached out to our cycling solicitors for help. After speaking to him about his situation, our solicitor Seymour Major advised that we could help him with his claim.

Defendant Denies Allegations

The defendant denied the allegations made by the plaintiff. They challenged his version of events and particularly disputing the involvement of a ladder or any negligence on their part, asserting their operations were safely executed within the demarcated zone.

High Court Proceedings

At the heart of the plaintiff’s claim was the assertion of negligence and a breach of statutory duty on part of the defendant’s employees amidst ongoing road work operations. Despite safety indicators such as barriers, the plaintiff was met with a hazard that should not have been present. The defense contested these claims, staunchly denying the allegations and maintaining a stance that their procedures were faultless and within safety guidelines. Central to the High Court’s proceedings was a meticulous evaluation of witness credibility, tasked with unravelling the truth behind the conflicting narratives presented by both parties.

Our solicitor Seymor Major gathered evidence to present a robust case in his favour. The legal journey was thorough, with every piece of evidence, from medical reports to the detailed discrepancies between the incident accounts, were carefully examined. The evidence determined that the plaintiff’s injuries were not just physical—a severe elbow fracture requiring surgery—but also profoundly affecting his day-to-day life and work.

High Court Hearing

The case proceeded to a hearing, with no settlement offer made. The parties agreed to a figure of £75k, subject to liability. Evidence was presented by witnesses from both sides during the hearing.

At the core of this case lay the credibility of both plaintiff and defense witnesses. After careful consideration of all evidence, the judge deemed the plaintiff to be an honest and truthful witness. Conversely, the judge found the various defense witnesses to lack credibility. Consequently, the judge ruled in favour of the plaintiff, awarding him £75,000 plus interest.
