Jack’s serious motorcycle accident settles for £900,000 (Newtownabbey)

Jack was involved in a serious, life-changing motorcycle accident when a car coming the opposite way cut across his path. He was knocked off his bike and flung a sizable distance across the road. Instinctively, Jack got up and then collapsed into a ditch. The police happen to be upon the scene of the accident by chance.

Jack was taken by ambulance to the Royal Victoria Hospital where he was detained for 1 week and then transferred to the Ulster Hospital, Dundonald. He remained in hospital for 8 weeks. As a result of this accident, he sustained multiple injuries across his body and he underwent numerous surgeries.

It was clear from the nature of Jack’s injuries that he would be left with lifelong issues with regard to his lower limbs. Medical reports were obtained from a consultant orthopaedic surgeon, a psychiatrist, a plastic surgeon as well as a thoracic surgeon.

As a result of his injuries, it was clear that Jack, who had done some training to be a chef, would not be able to pursue a career that involved prolonged standing. It was necessary to obtain a report from an occupational psychologist to look at his employment prospects and to confirm whether he would be in a position to pursue his chosen career. High court proceedings were issued. The defence solicitors, despite the fact their client was convicted of causing grievous bodily harm by careless driving, declined to accept liability. It was necessary to obtain a report from a consulting engineer, and this clearly established that the Defendant was at fault for the accident and that no blame whatsoever attached to our client. The matter was subsequently listed for trial. Prior to the trial, negotiations took place. An offer of £500,000 was made. This was rejected out of hand. On the morning of the trial and increased offer of £750,000 was made. Again, this was rejected. Finally, an acceptable offer of £900,000 plus CRU was made and this was accepted.
