David's Motorcycle Accident Settles for £200k (Bangor)
David was riding his motorcycle near Bangor when a car unexpectedly pulled out from a side road causing a collision that threw him from his bike. He was taken to the Ulster Hospital by an Ambulance. The accident caused David to suffer from a serious injury to his left leg and foot which involved fractures to multiple bones. Unfortunately, this shattered David’s dream of following in his father’s footsteps by enlisting in the armed forces.

The injury was further complicated when David developed compartment syndrome, a condition that occurs when pressure and swelling in the muscles builds to dangerous levels. This required immediate surgery known as a fasciotomy in order to save David’s leg. Fasciotomy incisions are left open to allow the pressure in the muscles to decrease. Thankfully, the operation was a success and his leg was saved. David’s leg was fitted with a type of cage but he needed several more operations to close the fasciotomies.

As a result of the serious injuries that he sustained, David decided to pursue a claim for compensation. We took instructions from David and sent a letter of claim to the insurer of the driver of the car involved. Liability for the motorcycle accident was quickly admitted. We had David examined by an Orthopaedic Surgeon, a Plastic Surgeon, Consultant Chest Physician and a Consultant Psychiatrist who each provided us with a specialist medical report as evidence.

It was clear that, due to his injuries, he would no longer be in a position to join the armed forces as he would not be able to pass the numerous fitness tests. To complicate matters, David had a background history of dyslexia meaning a number of jobs in the civilian market place would not suit him, making the loss of a military career all the more devastating. We obtained a further report from an Employment Psychologist who we requested to spend some time with David. In addition, we also obtained a report from an Occupational Therapist to assess the nature of care which David’s family had been providing him with so that they could be reimbursed for their time. Finally, and using all of the reports we had obtained, we commissioned a forensic accounts report which charted out the financial loss that David may suffer in the future.

We issued High Court Proceedings and the matter was listed for trial. Prior to the trial, we negotiated with the car driver’s insurer and settled the case in the sum of £200,000.
