Liam’s car accident claim settles for £5,500 (Belfast)

Liam was driving along the M3 motorway in Belfast when he suddenly became aware of the sound of sirens in front of him. The vehicle in front braked quickly as did Liam, but the vehicle behind crashed into the back of him. The rear driver who caused the accident admitted full liability at the scene of the accident.

Damage was sustained to Liam’s rear bumper which had to be replaced

Liam suffered an injury to his neck, mid to upper back and his knee. He also had some initial headaches. The insurers for the driver who caused the crash contacted Liam in an attempt to settle the matter directly. At this stage, Liam had not obtained independent legal advice. They offered him £1,400 for his injuries and repair of his vehicle. Fortunately, Liam appreciated that the insurance company were not acting in his best interest and chose to contact Paschal O’Hare Solicitors.

Liam avoided third-part capture

Our principal solicitor, Patrick O’Hare initiated a claim for compensation and we had Liam examined by a Consultant Orthopaedic Surgeon who provided us with a medical report. This confirmed that Liam’s neck injury recovered within 3 weeks and that he would have intermittent symptoms in his mid to upper back for at least 12 months. Patrick then entered negotiations with the other driver’s insurance company and the matter was settled in the sum of £5,500.

In this instance, our client was lucky not to have agreed to compensation prior to obtaining an independent medical report. Some insurance companies purposely make low offers of compensation soon after the accident, this is known as third-party capture and you can learn more about it here.
