Barbara was injured in a car accident in Bangor. She was on Church Street when another vehicle collided with the side of her vehicle. She was checked over by paramedics at the scene, she subsequently attended the Ulster Hospital in relation to her injuries.

Barbara contacted Paschal O’Hare on a recommendation from a friend. Our team quickly established that we could assist in bringing a claim for compensation arising out of the incident. Given that the statute barred date was fast approaching, we immediately issued protective proceedings in the High Court.
A letter of claim was directed to the third party insurer setting out our client’s allegations against them. The third party insurer refused to concede liability, and the court proceedings were then served upon them.
We gathered Barbara’s medical records relating to the accident. Barbara had attended a number of sessions of physiotherapy following the accident. We arranged for Barbara to be examined by a Consultant Orthopaedic Surgeon, and provided the Consultant with the notes and records. Barbara was suffering from pain in her neck and right shoulder as a result of the accident. The medical report documented the reduction of Barbara’s recreational activities as a result of her injury. The Consultant Orthopaedic surgeon related symptoms to the accident for a period of 18 months. In addition, Barbara reported symptoms of nervous shock arising from the accident, we therefore arranged an examination of Barbara by a Consultant Psychiatrist. The Consultant Psychiatrist diagnosed travel anxiety for a period of 4 months.
We served our client’s medical evidence alongside our Statement of Claim. We also instructed Counsel on our client’s behalf. A Defense to the action was served by the Defendants. Upon receipt of this, our solicitor Chris McAllister wrote to the Defendants asking them to reconsider their position, and inviting them to a joint consultation with a view to entering into settlement discussions. A joint consultation took place at the High Court and a figure of £17,500 was negotiated, which Barbara was delighted to accept.
